The Virginia Condominium Act (§§ 55.1-1900, et seq., of the Code of Virginia), contains several provisions pertaining to insurance requirements for condominium unit owners associations. Rolling Valley Office Park condominium maintains a master casualty policy affording fire and extended coverage with the full replacement value of the structures within the condominium. Article 6 of the Rolling Valley Office Park bylaws more specifically addresses insurance requirements for the office park.
Section 6.2 of Article 6 specifically requires the Board of Directors to maintain comprehensive general liability coverage and an "all-risk" form policy of fire insurance with extended coverage, vandalism, malicious mischief, debris removal and water damage endorsements, insuring the entirety of the condominium property. Policy coverage is also required for all air conditioning and heating equipment, the interests of the Rolling Valley Office Park Unit Owners Association, the Board of Directors and all unit owners and their mortgagees. The comprehensive RVOP insurance package is currently provided by The Hartford Insurance Company, through Braddon Insurance Advisors, 5201-B Lyngate Court, Burke, Virginia 22015. Under Section 6.5 of Article 6 of the RVOP Bylaws, each unit owner is encouraged, but not required, to obtain insurance coverage for the personal property within the owner’s unit and personal liability coverage. These coverages are normally called "improvements and betterments coverage." Where a unit is leased, the owner should also consider additional coverages, such as loss of rents and medical payments and should consider requiring any tenant to maintain similar coverages, with the owner/landlord named as an additional insured on the tenant’s policy.
When securing a mortgage on a unit, the lender will normally require evidence of the condominium master insurance policy of the unit being pledged as security for the loan. An owner may secure a Certificate of Insurance (COI), which will include a mortgage clause in favor of the lender.
