All units within the Rolling Valley Office Park are zoned C-2, Limited Office District. The C-2 zoning classification precludes most retail and all residential usages, a variety of personal service establishments and most restaurants. Any change in current occupancy of a unit must receive the approval, in the form of an Occupancy Permit issued by the Fairfax County Planning and Zoning Department. In addition, new businesses must file a Fairfax County business license application within 75 days of the date the business begins. Section 5.8 of the Dominion Green Office Condominium Bylaws provides that no unit within Rolling Valley Office Park may be used for any purpose not permitted by the Fairfax County Zoning Ordinance and requires all leases to be submitted to the Board of Directors for review. Leases must also contain a provision "providing that the Board of Directors has the power to terminate the lease."
All business and usages of units within the Rolling Valley Office Park must be operated within the approved guidelines of both the Fairfax County Zoning Ordinances and the RVOP Condominium Bylaws.
Whether a unit is in compliance with the rules, or whether its use, for example, meets Fairfax County zoning requirements, is not information necessarily readily available to the Rolling Valley Board Office Park Directors. Interested parties must exercise due diligence in investigating the physical condition and usage associated with any unit being sold, rented or leased.
The Board does not actively inspect units for compliance nor review available documents to assure that a particular unit or business operating within a unit meets zoning requirements, has secured a business license, etc. However, if a matter of noncompliance is self-evident, or it is brought to the attention of the Board of Directors, any such matter will be investigated and corrective action taken.
